Rental Agreement Terms & Conditions

STUDENT BAND RENTAL AND EXCHANGE POLICY: Rental agreements are on a monthly basis. Signer has the right at any time to pay the remaining unpaid balance due under this agreement without penalty. There is never any obligation to purchase the instrument and Signer may return or exchange the instrument with the written permission of a Heid Music representative. Rent-to-Own-It Plan Policy: 100% of rental fees apply towards the purchase price of the original instrument or a student band instrument of equal or greater value through the full term of the rental. If the instrument is approved in writing for exchange to an instrument of lesser value after the first year, only the first year of paid rent will apply to the Rent to Own It Plan. Signer can eventually own the original or exchanged instrument by completing the full stated term of monthly rental payments. Any questions on Rent-to-Own agreement lengths, instrument values, and payoffs, please contact your local Heid Music. Rent It Plan Policy: This rental agreement is on a monthly basis and may be terminated by thirty (30) day mailed notice requiring immediate return to a Heid Music representative and/or by return of the instrument to a Heid Music representative. No rent applies to purchase. This instrument can be converted to a Rent-to-Own plan, but NO prior rental payments will apply to purchase.

 

STUDENT ORCHESTRA RENTAL AND EXCHANGE POLICY: Rental agreements are on a monthly basis. The Signer may return the instrument at any time upon delivery to a Heid Music representative and receipt of a written receipt. Rental money does not apply to the student level instruments. When Signer or Signer's child is ready for a larger size instrument, the rented instrument may be exchanged for a larger size instrument. Upon written approval of a Heid Music representative, up to two years of the Signer's rental payments will apply to the purchase of a full-size intermediate or professional orchestra instrument while the agreement is active. The Signer may exchange between silver and gold plans without forfeiture of rent credit.

 

TERMS: Title and right of possession of the instrument shall remain with Heid Music until total timely payments equal the rent to own price (plus sales tax) of the instrument, and all obligations are fulfilled by Signer under this agreement. Ownership will be transferred to Signer upon fulfilment of such terms by Signer and upon a signed receipt by a Heid Music representative. If rental payments are not paid when due and the instrument is not returned to a Heid Music representative within ten (10) days, Heid Music reserves the right to take possession of the instrument. Failure to return the instrument to a Heid Music representative within ten (10) days of expiration of this agreement or failure to abide by its terms results in theft pursuant to Wis. Stat. § 943.20(1)(e). Signer agrees not to sell, mortgage, remove from the state of Wisconsin without written permission from Heid Music, or otherwise dispose of this instrument during the rental agreement. Signer understand that this agreement may be terminated if Signer moves and fail to provide Heid Music with a new address, or if child changes school districts. If this agreement is terminated, Signer will return the instrument and any originally designated accessories (i.e. instrument case, orchestra bow, etc.), in good condition, to Heid Music or authorized agent immediately. Schools are not authorized agents.

 

MAINTENANCE AND REPAIR (M&R) COVERAGE TERMS AND CONDITIONS: The monthly rate for M&R is $5.00. Coverage is solely for keeping the instrument in good playing condition. Repair coverage specifically does not cover dents, scratches and cosmetic flaws that have no effect on the playing condition of the instrument as solely determined by a Heid Music representative. Coverage does not include lost parts. Also excluded are expendable items such as reeds, swabs, lubricants, mallets, drumsticks, drumheads, rosin and strings. Repair coverage will be considered “Not in Force” if payments are in arrears at the time of repair. Heid Music or one of its affiliates must make all repairs. No other claims will be considered. DO NOT ATTEMPT ANY REPAIRS ON YOUR OWN AS IT MAY VOID THE COVERAGE. Maintenance and repair costs are not refundable and do not apply to purchase.

 

STUDENT INSTRUMENT REPLACEMENT PLAN (IRP) TERMS AND CONDITIONS: The monthly rate for IRP coverage is $3.00, due on the monthly payment date and applies to the current month only. IRP coverage will continue as long as all payments under this agreement do not fall into arrears. Under this plan, Heid Music guarantees to replace the instrument with one of comparable age and condition if the instrument is lost through theft, fire or irreparable damage as determined by a Heid Music in its sole discretion. Notification of the theft must be made to the proper authorities and Heid Music within ten (10) days of occurrence or the replacement guarantee will be void and Signer will be liable for payment in full of the outstanding balance due under this agreement. Purchase of the Student Instrument Replacement Plan is voluntary. If Signer has declined this plan and instrument is lost through theft, fire or irreparable damage, he/she will be liable for full value of the instrument and case contents. At the completion of the term of this agreement, the customer will continue to be enrolled in the Student Instrument Replacement Plan for three dollars ($3.00) per month. Coverage of the plan beyond the completion of the agreement term is consistent with coverage during agreement term. Coverage can be cancelled at any time prior to next month’s billing by customer request.

 

PREFERRED PROTECTION EXTENDED MAINTENANCE PLAN: Throughout the term of this agreement, customer agrees to be enrolled in Heid’s Preferred Protection Extended Maintenance & Repair Plan for five dollars ($5.00) per month. At the completion of the term of this agreement, the customer will continue to be enrolled in the Preferred Protection Extended Maintenance Plan for five dollars and ($5.00) per month. Coverage of the plan beyond the completion of the agreement term is consistent with coverage during agreement term. See above sections for terms and conditions. Coverage can be cancelled at any time prior to next month’s billing by customer request.

 

PAST DUE ACCOUNTS: Only payments made on time apply to the purchase of the instrument. Any payment not made by the tenth (10th) day following the due date will be assessed a late charge of $5.00. Signer is responsible for notifying Heid Music at least ten (10) days prior to the due date of all proper account information to process any auto debit payments. Invalid information or insufficient funds will cause Signer’s account to be subject to non-sufficient fees of twenty dollars ($20.00). We have the right to process payment for any past due balances and fees incurred at any time and upon receipt of updated automatic payment information. If Signer’s account falls three (3) months into arrears it may be forwarded to a collection agency and Signer will be responsible for the full amount due on the instrument plus any additional collection fees incurred under applicable law. The agreement is not subject to the provisions of bankruptcy law as the money collected is rent. In the event that Heid Music incurs any expense in maintaining or defending any action or proceeding instituted by reason of any default on the Signer, such expense shall be the responsibility of the Signer, including reasonable attorneys’ fees. Any failure to pay or fully comply with these terms may result in Signer’s complete relinquishment of any rights of possession, as well as forfeiture of any right to purchase the instrument. Heid Music may provide a thirty (30) day mailed notice requiring immediate return to a Heid Music representative for any reason in their sole discretion.

 

NOTICE TO SIGNER: Forfeiture clause: If payment is in arrears and instrument is left at school, Heid Music legally has the right to take possession of the instrument. The Signer specifically consents to Heid Music obtaining credit information from a credit-reporting agency on Signer. There are no refunds for early returns, and Signer will be charged the full month’s rent and fees under the terms of the rental agreement in the month of return. Signer agrees to authorize Heid Music and its agents to communicate by phone, text or email, and through the use of an auto-dialer or prerecorded phone call at the telephone number provided.

 

SIGNER’S RIGHT TO CANCEL:  Signer may cancel this agreement by mailing a written notice to Heid Music, 308 E. College Avenue, Appleton, WI 54911, via email at cancel@heidmusic.com or by calling any Heid Music location. Any notice to Signer will be sent to the address as provided under the account information of this rental agreement. Payments will continue to be deducted from Signer’s account until the instrument is returned to Heid Music or an agent thereof. School and school music educators are not agents of Heid Music. Leaving an instrument with a school music educator does not cancel this agreement.

 

DAMAGES: Any damages to rental property outside of typical wear and tear by usual responsible use of said property that are found to be caused by intentional, reckless, or malicious acts while in the possession of the Signer and/or their agents, as determined by the reasonable discretion of a Heid Music representative, shall cause this agreement to be immediately terminated. Signer is responsible for the cost of said repairs and or the replacement value of the equipment due to such damages.

 

INDEMNIFICATION: Signer shall indemnify Heid Music and its officers, directors, employees, agents, affiliates, successors, and permitted assigns against any and all losses, damages, liabilities, deficiencies, claims, actions, judgments, settlements, interest, awards, penalties, fines, costs, or expenses of whatever kind, including reasonable attorneys' fees, that are incurred arising out of or related to any third-party claim.  

 

MISCELLANEOUS: (a) This agreement constitutes the entire agreement of the parties relating to the rental of instruments and related matters and supersedes all previous agreements, discussions, representations, and correspondence between the parties. It is understood and agreed that no agreement, guaranty, warranty or duty, express or implied, not expressed herein shall limit or qualify the terms of this agreement. (b) This agreement may only be amended in a writing signed by both parties. (c) This agreement shall be governed by the laws of the state of Wisconsin, without regard to conflicts of laws provisions. The parties stipulate and agree that venue and jurisdiction shall be proper in Outagamie County Wisconsin.
